Revenue and Taxation Code (RTC), Section 34019, subd. (f)(3)(C) states the BSCC will provide grant funds to local governments that assist with law enforcement, fire protection, or other local programming to address public health and safety associated with the implementation of the Control, Regulate and Tax Adult Use of Marijuana Act.

In 2019, language in the RTC prohibited the BSCC from making grants to any local governments that have banned all indoor and outdoor cultivation, including personal cultivation, or retail sale of marijuana or marijuana products. Then in 2020 with the passage of Assembly Bill (AB) 1872, eligibility for Proposition 64 Public Health & Safety (Prop 64 PH&S) Grant funding solicitations were broadened again. The RTC Section was changed to make eligible any local government that did not ban both indoor and outdoor commercial cannabis cultivation, or ban retail sale of cannabis or cannabis products pursuant to Section 26200 of the Business and Professions Code or as otherwise provided by law.

Per Senate Bill 141 (approved by the Governor June 27, 2025), the RTC was updated again for the purposes of broadening eligibility for grant funding administered by the BSCC: A local government shall be eligible for a grant only if it either allows the retail sale of cannabis in storefronts or, for jurisdictions with a population of 10,000 residents or less, allows cannabis delivery in the jurisdiction that serves both medicinal and adult-use consumers. The Board of State and Community Corrections shall prioritize grant awards for local governments whose grant application includes illicit cannabis enforcement. The board may award grants both competitively and based on a formula to provide consistent and ongoing funding for local governments to implement the programs described in this subparagraph. A local Government shall be eligible for a grant only if it either allows the retail sale of cannabis in storefronts or, for jurisdictions with a population of 10,000 residents or less, allows cannabis delivery in the jurisdiction that serves both medicinal and adult-use consumers. BSCC shall prioritize grant awards for local governments whose grant application includes illicit cannabis enforcement.

Prop 64 PH&S Grants - Cohort 4

The BSCC is currently seeking subject matter experts to serve on the Prop 64 Cohort 4 Scoring Panel. Scoring Panel members will be responsible for reading and rating eligible proposals submitted to the BSCC for the next round of grant funding. Prop 64 PH&S Grants - Cohort 3

At the April 13, 2023 BSCC Board meeting, 37 jurisdictions were awarded, in total, almost $94 million in the third round of Prop 64 PH&S Grant funding. The 5-year grant service period began May 1, 2023 and will end April 30, 2028.

Cohort 1 Statewide Evaluation Report: From 2020 to 2023, BSCC awarded $24.7 million to ten grantees for programs addressing youth prevention, health education, enforcement, and environmental impacts.Grantees served over 1,800 youth and thousands more through outreach, achieving outcomes like reduced substance use and increased awareness of cannabis risks. Despite pandemic challenges, programs adapted and completed major enforcement actions, including eradicating 960,000 illegal plants and conducting extensive community education.
