NOTICE OF MODIFICATIONS TO TEXT OF PROPOSED REGULATIONS

Pursuant to the requirements of Government Code section 11346.8(c) and section 44 of Title 1 of the California Code of Regulations, the Board of State and Community Corrections (BSCC) hereby provides notice of changes made to proposed regulation section 1029.  Section 1029 was subject to a 45-day public comment period between March 4, 2022, and April 18, 2022; a public hearing occurred on May 2, 2022.

Changes outlined in the modified text are in response to the passage of Assembly Bill 490 (chapter 407, statutes of 2021); which amended Government Code section 7286.5 to prohibit carotid restraint or choke hold by any peace officer. The amended language became effective on January 1, 2022.

EDITORIAL CORRECTIONS
The Proposed Text of Regulations noticed to the public on March 4, 2022, contained text erroneously shown in underline and strikeout. Brackets have been placed around text where the errors occurred and explanations provided in the appended Text of Modified Regulations document.

WRITTEN COMMENT PERIOD

All written comments received by July 15, 2022, which pertain to the indicated changes will be reviewed by the BSCC and will be summarized and responded to in the Final Statement of Reasons.  Please limit your comments to the modifications to the text in section 1029.
